Privacy Policy

This Privacy Policy explains how Anne Sostman PLLC, a licensed Arizona real estate professional operating under The Brokery (referred to as "we," "us," or "our"), collects, uses, shares, and protects information when you visit annesostman.com (previously amsrealtyaz.com), submit a form, call or text us, or otherwise communicate with us.
Please read the sections on calls and on automated and AI-assisted communication carefully. They describe how we may contact you and how you can stop that contact at any time.
1. Information We Collect
Information you provide. When you submit a form, request a valuation or analysis, book a consultation, use the chat, or contact us by phone, text, or email, we collect what you choose to give us. That typically includes your name, email address, phone number, property address, price range, timeline, and any details you include in a message.
Information collected automatically. When you use the site we automatically receive technical and usage information, including IP address, browser and device type, pages viewed, referring page, search terms used on the site, and the dates and times of your visits. This is collected through cookies and similar technologies described in Section 5.
Property search activity. Our property search is powered by a third-party IDX provider (Buying Buddy). If you create an account, save a search, or save a listing, that provider collects and stores your search activity, saved properties, and account details, and makes that information available to us. Their handling of your information is also governed by their own privacy policy.
Information from other sources. We may receive information about you from public records, county assessor and recorder data, the Arizona Regional Multiple Listing Service, our brokerage, lenders or title companies involved in your transaction, marketing partners, and data providers we use to verify or complete contact details. We combine that with information you give us.
2. Telephone Calls, Voicemail, and Monitoring
Calls to and from our business lines may be monitored, recorded, or transcribed for quality assurance, training, accuracy of transaction records, and to maintain a record of what was discussed. This may apply to both incoming and outgoing calls.
Where a call is recorded, we will disclose that at the start of the call. If you do not consent to being recorded, tell us at the beginning of the call and we will either continue without recording or continue in writing instead. You may also ask us at any time whether a specific call is being recorded.
Some incoming calls may be answered by an automated assistant that speaks with you, takes a message, and creates a written summary or transcript of the conversation for us to review. You may ask to speak with a person instead at any time.
Call records, summaries, transcripts, and any recordings are stored in our customer relationship management system and treated as confidential business records, subject to the sharing and retention terms below.
3. Automated and AI-Assisted Communication
By submitting a form on this site, or by giving us your contact information by phone, text, email, chat, or in person, you agree that we may contact you at the phone number and email address you provide. That contact may include calls, text messages, and emails, and those communications may be generated, drafted, prioritized, personalized, scheduled, or delivered with the assistance of automated systems and artificial intelligence, including automated telephone dialing systems and artificial or prerecorded voice messages.
Consent to receive marketing communications is not a condition of buying or selling a home or of receiving any service from us. You may request information from us without agreeing to marketing contact by calling or emailing us directly and telling us so.
Message frequency varies. Message and data rates may apply.
How to stop contact.
- Text messages: reply STOP to any message to opt out of further texts. Reply HELP for assistance.
- Email: use the unsubscribe link in any marketing email, or reply asking to be removed.
- Calls: tell us on any call, or contact us using the details in Section 14, and we will add you to our internal do-not-call list.
- You may also ask us to stop all contact through every channel, and we will honor that request.
We maintain an internal do-not-call and do-not-contact list and we honor opt-out requests across channels. Marketing calls and texts are sent only between 8:00 a.m. and 9:00 p.m. in your local time zone. Responses to your own inquiries may be sent outside those hours.
An automated assistant may draft or send messages on our behalf, and may answer inbound calls or chat messages. Communications from us, however generated, are sent under our supervision and we remain responsible for them.
4. How We Use Information
- To respond to your inquiries and provide the services you request, including property searches, valuations, market analyses, and representation in a transaction.
- To prepare, negotiate, and complete real estate transactions, including sharing information as needed with the other parties and professionals involved.
- To send you listings, market updates, guides, and other marketing communications, subject to your consent and the opt-out rights above.
- To operate, maintain, secure, and improve the website and our services, and to measure the performance of our marketing.
- To create and maintain records of our communications and transactions.
- To comply with legal, regulatory, licensing, brokerage, and multiple listing service obligations, and to establish or defend legal claims.
5. Cookies, Analytics, and Advertising
We use cookies and similar technologies to operate the site, remember your preferences, understand how the site is used, and measure and improve our advertising. Specifically we use:
- Google Analytics, to understand how visitors find and use the site.
- Google Ads and Google Tag Manager, to measure advertising performance and to show ads to people who have visited the site. This may involve sharing a hashed identifier with Google.
- Our IDX property search provider, which sets its own cookies to operate search, saved searches, and accounts.
Most browsers let you refuse or delete cookies through their settings. Some parts of the site, particularly property search, may not work properly without them. You can opt out of Google Analytics using Google's browser add-on, and you can adjust Google ad personalization in your Google account settings. We do not currently respond to browser Do Not Track signals, as there is no common standard for them.
6. How We Share Information
We do not sell your personal information for money. We share information in these circumstances:
- Service providers who operate our systems on our behalf, including our customer relationship management platform, email and text messaging providers, telephone provider, IDX and website hosting providers, and analytics and advertising platforms. They may use the information only to provide services to us.
- Our brokerage, as required by Arizona real estate licensing rules and brokerage policy.
- Transaction participants, when you engage us in a transaction. This can include the other party and their agent, title and escrow companies, lenders, inspectors, appraisers, contractors, and the multiple listing service.
- Legal and safety, when required by law, subpoena, court order, or regulatory or licensing authority, or when necessary to protect our rights, safety, or property, or that of others.
- Business transfers, in connection with a merger, acquisition, or sale of assets, subject to this policy.
Some advertising practices described in Section 5, such as sharing identifiers with advertising platforms for targeted advertising, may be considered a "sale" or "sharing" of personal information under certain state privacy laws. See Section 9 for how to opt out.
7. Data Retention
We keep personal information for as long as needed for the purposes described in this policy. Transaction records and related communications are retained for the period required by Arizona real estate law, brokerage policy, and our tax and insurance obligations, which is generally at least five years after a transaction closes. Marketing contacts and inquiry records are kept until you ask us to delete them or until they are no longer useful, whichever comes first. Records of opt-out and do-not-contact requests are kept indefinitely so that we can continue honoring them.
8. Security
We use administrative, technical, and physical safeguards designed to protect your information, including encrypted connections to this website and access controls on our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive information such as Social Security numbers, full financial account numbers, or copies of identification documents by unsecured email or text. We will tell you how to transmit those securely when they are needed.
9. Your Privacy Rights
Depending on where you live, you may have the right to request access to the personal information we hold about you, request correction or deletion of it, request a copy in a portable format, opt out of targeted advertising or of the sale or sharing of your personal information, and to not be discriminated against for exercising these rights.
To make a request, contact us using the details in Section 14. We will ask for information sufficient to verify your identity before acting on a request, and we will respond within the time required by applicable law. You may authorize an agent to make a request on your behalf, and we may ask that agent for proof of authorization.
Some information cannot be deleted on request, including records we are required to keep under real estate licensing, brokerage, multiple listing service, tax, or other legal obligations, and records needed to honor your opt-out requests.
10. Children
This site and our services are intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we will delete it.
11. Fair Housing
We conduct our business in accordance with federal, state, and local fair housing laws. We do not use, request, or consider race, color, religion, sex, familial status, national origin, disability, or any other protected characteristic in providing our services, and we do not use such characteristics to target or exclude anyone in our advertising.
12. Third-Party Websites and Services
This site links to and embeds services operated by others, including property search, valuation tools, scheduling, chat, mapping, and social media. Those services collect information under their own privacy policies, which we do not control. We encourage you to review the privacy policy of any third-party service you use.
13. Changes to This Policy
We may update this policy as our practices, technology, or the law changes. The effective date at the top of this page indicates when it was last revised. Material changes will be posted here. Your continued use of the site after a change means you accept the updated policy.
